Welcome to F1RST MOTORS. These Terms of Service govern the use of our website, booking services and luxury vehicle rental services in Spain.

By making a booking or renting a vehicle from F1RST MOTORS, you agree to these terms and the specific conditions outlined in your individual rental agreement.

1. About F1RST MOTORS

F1RST MOTORS is a luxury vehicle rental company based in Spain, offering customers the opportunity to experience exceptional vehicles for periods ranging from a minimum of 5 hours to a maximum of 1 month, subject to availability and agreement.

Our objective is to provide a premium, safe and professional luxury driving experience.

2. Booking and Reservations

All bookings are subject to vehicle availability and confirmation by F1RST MOTORS.
A booking is considered confirmed once the required payment or deposit has been received and confirmation has been issued.
Customers must provide accurate personal and contact information when making a reservation.
Rental periods, collection arrangements and return details will be confirmed before the rental begins.
Any special requests must be agreed with F1RST MOTORS in advance.

3. Driver Eligibility

To rent a vehicle, customers must:

Hold a valid driving licence recognised in Spain.
Meet the minimum age and driving experience requirements applicable to the selected vehicle and insurance policy.
Provide valid identification and any additional documentation reasonably required.
Be authorised as a driver under the rental agreement.

Additional drivers must be approved and registered before operating the vehicle.

F1RST MOTORS reserves the right to refuse a rental where eligibility or insurance requirements are not satisfied, subject to applicable law.

4. Rental Period

F1RST MOTORS offers rental periods starting from 5 hours and extending up to 1 month.

The rental period begins and ends at the times specified in the booking confirmation or rental agreement.

Any extension must be requested and approved before the original return deadline. Extensions are subject to availability, applicable charges and written confirmation.

5. Payments and Security Deposits

Customers agree to pay all rental charges, deposits and additional fees communicated during the booking process.

Depending on the vehicle and rental period, a refundable security deposit may be required before collection.

The deposit may be used, where contractually and legally permitted, to cover outstanding rental charges, damage, missing equipment, traffic penalties or other amounts for which the customer is responsible.

Deposit release will be handled in accordance with the rental agreement and any applicable inspection or claims process.

6. Vehicle Collection and Return

Customers must collect and return vehicles at the agreed location and time.

Vehicles must be returned in the condition in which they were supplied, allowing for normal wear and tear.

The customer must return all keys, documents, accessories and equipment supplied with the vehicle.

Late returns, unauthorised changes to the return location, excessive cleaning requirements and other additional services may incur charges where agreed in the rental contract.

7. Insurance and Customer Responsibility

Vehicles are provided with the insurance cover specified in the individual rental agreement.

Customers are responsible for understanding the insurance coverage, exclusions, excess amounts and any applicable limitations before accepting the vehicle.

Customers may be held responsible, subject to the rental agreement and applicable law, for damage, loss or costs arising from negligent, prohibited or unauthorised use.

No customer should assume that every type of damage or incident is covered by insurance.

8. Permitted and Prohibited Use

Vehicles rented from F1RST MOTORS must be driven responsibly and in compliance with Spanish traffic laws.

The following activities are prohibited unless expressly authorised in writing:

Driving under the influence of alcohol, drugs or any substance that impairs driving ability.
Allowing an unauthorised person to drive the vehicle.
Using the vehicle for racing, track days, competitions or timed events.
Using the vehicle for commercial activities, subletting or ride-hailing services.
Taking the vehicle outside the agreed geographical area or Spain without prior written permission.
Using the vehicle for illegal activities.
Overloading the vehicle or using it in a manner inconsistent with its intended purpose.
Tampering with, modifying or disabling vehicle safety or tracking equipment.

Any breach may result in termination of the rental, subject to the rental agreement and applicable law.

9. Traffic Fines and Penalties

Customers are responsible for traffic fines, parking penalties, tolls and other charges incurred during their rental period, to the extent attributable to their use of the vehicle.

Where F1RST MOTORS receives a penalty relating to the rental period, we may provide the relevant driver information to the competent authority where legally required.

Any permitted administration charges will be disclosed in the rental agreement.

10. Accidents, Damage and Breakdowns

In the event of an accident, theft, damage or mechanical breakdown, customers must:

Stop safely and contact the relevant emergency services where necessary.
Notify F1RST MOTORS as soon as possible.
Follow the instructions provided by the rental company and insurer.
Obtain the details of any other parties involved.
Take photographs and collect relevant evidence where safe to do so.
Complete any required accident or insurance documentation.

Customers must not arrange repairs or authorise work without prior approval, except where emergency action is necessary for safety or required by law.

11. Cancellations and Amendments

Cancellation, rescheduling and refund conditions will be communicated during the booking process and detailed in the applicable rental agreement.

Any cancellation or amendment request must be submitted through the official F1RST MOTORS contact channels.

Where applicable, cancellation charges will be disclosed before the customer confirms the booking. Mandatory consumer rights under Spanish and European law will always be respected.

12. Vehicle Availability and Substitution

Although F1RST MOTORS makes every effort to provide the vehicle selected by the customer, availability may occasionally be affected by unforeseen circumstances, maintenance or operational requirements.

If the booked vehicle becomes unavailable, F1RST MOTORS will contact the customer to discuss an appropriate alternative or other available resolution in accordance with the rental agreement and applicable law.

13. Website Use and Intellectual Property

All website content, including logos, branding, photographs, text, graphics and design elements belonging to F1RST MOTORS, is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed or commercially used without prior written permission.

Users agree not to misuse the website, interfere with its operation or submit false, misleading or unlawful information.

14. Privacy and Personal Information

F1RST MOTORS respects customer privacy and processes personal information in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) and relevant Spanish legislation.

Personal information may be processed for bookings, identity verification, rental administration, payment processing, customer support and legal compliance.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

F1RST MOTORS will not be responsible for losses arising from circumstances beyond its reasonable control, subject to applicable legal obligations and consumer rights.

Any liability relating to vehicle rental, insurance, damage or service interruption will be assessed in accordance with the rental agreement and applicable law.

16. Changes to These Terms

F1RST MOTORS reserves the right to update these Terms of Service when necessary.

Updated terms will be published on our website with a revised date. Changes will not retrospectively affect bookings except where permitted or required by law.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain.

Any disputes will be handled by the competent courts in accordance with applicable Spanish and European legislation, including mandatory consumer jurisdiction protections.
